Frankston City is set to become the first Victorian local council to introduce a local law which will empower authorised officers to impound illegally used monkey bikes, mini bikes and trail bikes for a minimum of six months.
Council is set to adopt General (Amendment) Local Law No. 12 - Motor Cycle/Noise Controls, at its next meeting on Monday, 1 October. Under the law it will be an offence for any person to ride an unregistered monkey bike, mini-bike or trail bike on roads and public places (i.e. nature reserves) in the municipality.
Penalties include fines and impoundment of illegally used motor cycles, which will increase for subsequent offences. The law defines a 'motorcycle' as any wheeled conveyance, powered by a liquid fuel driven motor, that is not registered under the provisions of the Road Safety Act 1986.
Any impoundment will be undertaken by the local police and the motor cycle will be handed to an agent appointed by Council for transfer to a holding yard.

First offence - six-month impoundment, plus $250 release fee and holding fee of $300
Second offence - 12-month impoundment, plus $250 release fee and holding fee of $600
In addition to the above penalties, authorised officers can fine the owner a further $200 for a first offence and $500 for subsequent offences. Under the law Council will also have the power to destroy any motorcycle impounded if the owner has not paid the fines within seven (7) days upon receiving the penalty notice.

That is true but you know I think this is more applicable to mini bikes such as pit bikes and such. They are generally much more valuable then a pocket bike. I have never seen a watercooled china rep or genuine euro made machine ridden illegal yet. What i've noticed is people on pocket bikes like cags tend to go back and forth and stick in one area where as those on pit bikes ride on the roads for long distances to travel to an off-road area to ride. In the area I just moved from there were alway guys on pit bikes usually with no helmets riding flat out on the road, defintely speeding and observing no road rules at all.
Sadly there is a minority (or is it the majority) that are spoiling it for all.
I've gotta admit though I take my bike onto the street out of the way for testing because the nearest track is 2 hours away. And i'll ride only just long enough usually back and forth till i have diagnosed the fault or tested whatever it was I needed to check then I put it away.
I'd be mighty dirty if i got busted for doing that. That would have me saying to the officier well i'm trying to do the right thing but if your going to crack down on me that hard the your saying I might as well have just gone for a ride around the suburbs and enjoyed myself in the mean time.

if the councils put the effort into helping out clubs there would be alot less people breaking the law
just another way to raise revenu for them to spend on nothing of use

the councils can make concrete jungles for scateboarders,why dont they give us lot a track!!!!!!!!!!!It would certainly get everyone off the streets.

yeah it sure would.
i may have another place that people can ride on,
my dads mate has bought a farm about 2 hours out of melbourne, and because he is into pocketbikes and gokarts and such, he is building a bit bitumen track.
i have no other information than what i just gave you at this present time, but thatll be one more track that people can go to.
and yeah, i reckon its so bogus how the council forks out money for skate parks and stuff, which mostly condone bad behaviour because people meet up and hang around there, thats one of the reasons why there is so much graffiti.
they should give money to places that will actually help the community, so they wont have to send out police to pick us up when real crimes could be going on

a few friends and i have always gone to great lengths to find places to test our bikes out of the way of residential areas and such, even on one or two occasions being stopped by the law passing by only to have one of them asking to test out one of our bikes! and reminding us of the penalties involved and it was good of us to find a place out of the way but it IS still illegal to ride PB's on the road. Use common sense people, riding your bike around your local neighbourhood especially if you have a blata rep or such that makes a hell of an exhaust note up and down the streets wil do nothing but draw attention of the local authorities.........
