Rear Brake Broken?? -- it's touching the metal disk

Just wondering if this is normal, it does not seem to be...

as the pictures show a section of the rear brake is touching the metal disk and I'm guessing causing drag.








Any and all thoughs/comments are welcome!

PS What is this part and what's it for? The front brake is NOT like this one!


Any/all help would be great, thank you in advance!!
